Interesting article:

Some reasons why there is no Erin Brockovitch of Strata.

a. Is there a principle which all stakeholders support? Water should be safe to drink cuts across the whole ecosystem – is there an equivalent in Strata?

b. Payout – In the Brochovitch scenario, Erin herself made over a million. I don’t know of strata lawyers doing “No win No fee” cases. In any case, the payout, should there be one, is rarely in that league.

c. White collar misdemeanours rarely make it to the front page. In Strata the “wrongs that need to be righted” involve owners losing money and Strata Managers getting “slapped on the wrist with wet spaghetti”. Not the stuff of legends!

d. Owners themselves need to start the campaign, but they rely on professionals and they do not have the same goals.

For example:

1. Contracts of Appointment, are generally written in favour of Strata Managers.

2. “Privacy” is used to prevent communication between owners. The Strata Managers control the narrative.

3. “Legalese Word Salads” are used in the presentation of Minutes. Owners get intimidated.

4. Financial Statements are designed to give little detail to owners.

5. There is no financial incentive for Strata managers to be transparent. In fact it is the opposite – less transparent equates to more fees.

5. There are no Strata Police, disputes are solved a long time after the offense has occurred and VCAT cases rarely get publicised - so "bad players" can continue being bad.
