DEFECTIVE: All About Strata Building Defects
Useful information about strata building defects to help get better outcomes …
More buildings, more and bigger defects, and fewer protections are intersecting with new laws, complicating superior Court decisions, government ‘fix-it’ programs, and increasing costs to make the long-running problem of dealing with strata building defects even more challenging [as if that was even possible?].
I’ve resisted scratching this itch for long enough now.
But everywhere I look I see strata building defects problems that need resolving; new defect claim laws; more serious defects in buildings; a few major cases; combustible cladding, strata owner class actions, etc, etc, etc.
So, here goes nothing.
I’m now launching Defective: a weekly review of an important aspect of the problem of strata building defects from me.
DEFECTIVE will vary from week to week, ranging across a variety of content, materials, and formats covering:
short takes on the latest defect news,
longer overviews of processes or legal regimes affecting building defect stakeholders,
case studies or worked examples of defect problems and solutions,
locating and highlighting research and useful literature,
histories [like my article “A Combustible Cladding Round-Up’]
flow charts, visualisations, and other strata tools,
comparative analyses of building defect regimes, plus
my thoughts about better and smarter ways to handle strata building defects.
I’ve got the experience and credentials on the topic with more than 25 years of experience recovering money for strata buildings with defects, working with most of the insurance, Tribunal, and Court based claim processes, training lawyers and experts in the field, lecturing, and, making submissions about necessary and appropriate reforms to state Governments.
After all, I’ve made successful strata building defects claims under every legal regime that’s existed since the 1980’s NSW House Purchasers Agreement [the history of which is explained in my article ‘The Saga of NSW Strata Defect Claims’].
And, I’m passionate about getting strata building quality up to a fair standard that’s sensibly intermediated between developers, builders, strata owners, and regulators.
So, if you’re dealing with strata building defects, watch out for DEFECTIVE: All About Strata Building Defects.
The first issue of DEFECTIVE drops Monday, April 19.
