An apartment seller was sued by the buyer for not telling them a crazy neighbour lived upstairs and made the place unbearable to live in. The WA Supreme Court ruled the seller had a responsibility to tell buyers about issues that might affect their right to live peacefully in their homes.
The upstairs neighbour would bang on his floor when he heard shower or hairdryer noise, play loud music early in the morning, and scream abuse.
It’s a sad state of affairs for everyone involved. But, the judge complained that the only one who didn’t suffer through this dispute was the crazy neighbour who, he said, should have been sued for nuisance.
