As a unique kind of real property, common property in a strata title scheme presents challenges. Common property is not completely analogous to other kinds of real property. Since it is almost entirely statutorily based, analysing the laws that create and govern it (in conjunction with limited judicial considerations of those laws) is the best way to understand common property. This paper is a beginning to that analysis.
In one of my past [strata] lives I presented at seminars and conferences around the world on strata title topics. My presentations varied from legalistic dissertations to fun ‘hypothetical’ style panels. And, you may as well have access to them via this newsletter.
So, here’s my presentation to the 2006 Annual Conference for the Australian College of Community Association Lawyers [now the Australian College of Strata Lawyers].
It’s about the unique nature of property ownership in a common title property scheme and some of the features, challenges, and questions about it.
It’s still surprisingly relevant today since the common property basics haven’t changed.
